Terms of Service – ChitraShakti

1. Who we are

ChitraShakti is operated by Chitrashakti Labs ("Company", "we", "us"), an Indian business headquartered in Pune, Maharashtra. These Terms govern access to the website (chitrashakti.com), mobile experience, APIs, and related services ("Service"). By creating an account, purchasing credits, or using the Service you acknowledge this binding agreement under Indian law. If you are acting on behalf of an organisation, you represent you have authority to bind that entity.

2. Eligibility & accounts

  • Minimum age: 18. Accounts for minors are not permitted.
  • Authentication is handled through Firebase (Google or phone OTP). Keep your credentials and device tokens secure and do not share them.
  • You are responsible for activities under your UID, including uploads, prompts, payments, and gallery content.

3. Credits, pricing, and payments

3.1 Credits

  • Credits are the unit used to run AI image generations and compositions across all creation modes (Compose, Craft Devotion, Folk Tales, Heritage Canvas).
  • Each generation consumes credits based on quality tier: Standard (1 credit), Premium HD (2 credits), Premium UHD (4 credits).
  • Credit consumption rates may change without notice based on operational costs, AI model pricing changes, or infrastructure expenses. Current rates are displayed in the generation interface.
  • Credits are digital consumable goods that are non-transferable, non-interest-bearing, and expire upon account deletion.
  • Unused credits have no cash value and cannot be refunded once successfully credited to your account.

3.2 Pricing

  • Pricing is published at /pricing and enforced server-side through canonical pricing configuration.
  • Current tiers (inclusive of 18% GST):
    • Trial: ₹99 for 10 credits
    • Value: ₹399 for 50 credits
    • Power: ₹699 for 100 credits
  • Prices may change at any time without notice based on operational costs, AI model pricing fluctuations, infrastructure expenses, currency exchange rates, or regulatory changes (including GST rate changes).
  • Price changes apply only to future purchases; credits already purchased remain valid at their original value.
  • We will display current pricing at the time of purchase, and your acceptance of the purchase constitutes agreement to the price shown.

3.3 Payment Processing

  • All payments are processed exclusively through Razorpay Software Pvt. Ltd., an RBI-authorized payment aggregator.
  • By initiating a purchase, you agree to Razorpay's Terms of Service and Privacy Policy (https://razorpay.com/privacy/).
  • We accept UPI, credit/debit cards (Visa, Mastercard, RuPay, Amex), net banking, and digital wallets.
  • Security: We never store full card numbers, CVV, card expiry dates, or UPI PINs. All sensitive payment data is handled exclusively by Razorpay's PCI DSS Level 1 compliant infrastructure.
  • Verification: Payments are verified using cryptographic signatures (HMAC SHA-256) through both frontend callback and server-side webhook for maximum reliability.

3.4 Payment Failures & Support

  • If payment is deducted from your account but credits are not delivered within 24 hours, contact billing@chitrashakti.com with your transaction ID (razorpay_payment_id) and order ID.
  • We maintain detailed transaction logs and webhook events for reconciliation and dispute resolution.
  • For duplicate charges, refunds will be processed within 5-7 business days upon verification.

3.5 Refund Policy

  • Digital credits are non-refundable once successfully credited to your account, as they are consumable digital goods under Indian law.
  • Refunds for technical errors or payment failures are handled on a case-by-case basis and processed to the original payment method within 7-10 business days.
  • Razorpay processing fees are non-refundable unless mandated by law.
  • Initiating chargebacks without first contacting us may result in immediate account suspension.

4. User content & license

  • "Content" includes photos, prompts, AI outputs, and feedback you submit. You retain ownership of uploads.
  • By submitting Content you grant Chitrashakti Labs a worldwide, royalty-free licence to host, process, and display it solely to provide the Service (generation, moderation, support, backups).
  • You are solely responsible for ensuring you have rights to all inputs and that they do not violate copyright, privacy, or publicity rights of others.
  • Prohibited inputs: unlawful material, nude/minor imagery, extremist propaganda, malware, or anything restricted under the IT Act, IPC, or Indian law.

5. Generated outputs

  • Outputs are generated using AI models (Google Vertex AI, Gemini) and may contain inaccuracies, artifacts, or unintended elements. We do not guarantee originality, exclusivity, or fitness for any particular purpose.
  • You may use outputs generated with purchased credits for personal or commercial purposes, subject to applicable laws.
  • You must not misrepresent AI-generated outputs as human-created works, infringe on trademarks, or violate intellectual property rights.
  • Generated images are stored in your Firebase Storage gallery until you delete them or the account is terminated.

6. Acceptable use

You agree not to:

  1. Attempt to breach Firestore, Razorpay, or Firebase security controls, reverse engineer rate-limiters, falsify webhook signatures, manipulate payment amounts, or bypass canonical pricing validation.
  2. Scrape or bulk download prompts/outputs beyond permitted API usage.
  3. Use the Service to harass, defame, incite violence, or violate Indian laws (IT Act, IPC, DPDP Act 2023, or other applicable regulations).
  4. Bypass purchase requirements, share credits, resell access, or create multiple accounts to abuse promotional offers without written permission.
  5. Attempt payment fraud, duplicate charge abuse, or malicious chargebacks.

7. Availability & changes

  • The Service operates on Firebase App Hosting (Asia-Southeast-1) and depends on third-party providers (Google Cloud, Razorpay, Upstash Redis).
  • We do not guarantee uninterrupted uptime or availability. Scheduled maintenance, security updates, or infrastructure outages may occur with or without notice.
  • Features, AI models, pricing tiers, quality options, or payment integrations may change or be discontinued. We will provide at least 7 days' notice for material changes affecting paid features.

8. Disclaimer & limitation of liability

  • The Service is provided "as-is" and "as-available". To the fullest extent permitted by Indian law, Chitrashakti Labs disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
  • We do not guarantee that AI-generated outputs will be free from errors, meet your requirements, or be suitable for any commercial use.
  • Chitrashakti Labs, its directors, employees, contractors, or partners will not be liable for indirect, incidental, consequential, or punitive damages, including loss of profits, data, goodwill, reputation, or business opportunities.
  • Aggregate Liability Cap: Our total liability for any claim arising out of these Terms will not exceed the total amount you paid for credits in the 90 days immediately prior to the claim, or ₹5,000, whichever is lower.

9. Indemnity

You agree to indemnify, defend, and hold Chitrashakti Labs harmless from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from:

  • Your Content or use of the Service
  • Violation of these Terms or applicable laws
  • Infringement of any third-party intellectual property, privacy, or publicity rights
  • Payment disputes, chargebacks, or fraudulent transactions initiated by you

10. Termination

10.1 Termination by Us

We may suspend or terminate your access immediately without notice if we reasonably suspect:

  • Payment fraud, chargebacks, or manipulation of pricing/credits
  • Policy violations, illegal content, or security breaches
  • Non-payment, expired payment methods, or abuse of refund policies
  • Legal risks or regulatory compliance issues

10.2 Termination by You

You may request account deletion at any time by contacting support@chitrashakti.com with your registered email and UID.

10.3 Effects of Termination

Upon termination:

  • All access to the Service is immediately revoked
  • Gallery images and prompts are deleted (subject to legal retention obligations)
  • Unused credits are forfeited with no refund (as they are consumable digital goods)
  • Payment records, transaction logs, webhook events, and tax documents are retained for 7 years as required by Indian Income Tax Act and GST regulations

11. Governing law & dispute resolution

  • These Terms are governed by the laws of India, without regard to conflict of law principles.
  • Any disputes, claims, or controversies shall be subject to the exclusive jurisdiction of the courts of Pune, Maharashtra, India.
  • We may seek injunctive relief in any competent court for breach of intellectual property, confidential information, or security violations.
  • Informal Resolution: Before initiating any legal proceedings, you agree to first contact support@chitrashakti.com to attempt informal resolution. We aim to resolve disputes within 15 working days.
  • For payment-specific disputes involving Razorpay, you may also contact Razorpay's support at support@razorpay.com.

12. Updates

  • We may revise these Terms to reflect product changes, pricing updates, new features, or regulatory compliance requirements.
  • Material changes will be communicated via email to your registered address and/or in-app notification at least 30 days prior to the effective date.
  • Non-material changes (typos, clarifications, contact information) may be made without advance notice.
  • Continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree, you must discontinue use and contact us for account termination.
